Factry BV (“we”, “us”, “our”) understands the importance of privacy of its applicants (“you”) and the protection of their personal data. This notice outlines the handling and processing of personal data during the application procedure.
The job applications are processed by Factry acting as a controller. It is important for us that we create and maintain an environment where our applicants, employees and former employees feel comfortable that their information will not be misused. We comply with the applicable data protection laws, such as the General Data Protection Regulation 2016/679 and national data protection laws. These data protection laws relate to the protection of your personal data and grants you rights in respect of your personal data. This notice aims to tell you which personal data we collect from you and how your data will be used following your job application.
By processing your application we may collect, store and use the following categories of personal information about you:
Collection occurs directly through one of our channels through which we collect personal data (f.ex. website, e-mail, career events, etc.) or indirect via third parties to whom you have submitted your personal data (f.ex. recruitment agencies)
Factry collects the abovementioned information solely for the purpose of processing your application. The personal data processed will be proportionate to the position to be filled and will be limited to the data necessary to ascertain to what extent your motivation, knowledge, skills, abilities, and experiences match the profile of the open position for which you are applying or qualifying.Whereas you have given your consent Factry might also keep your information for future opportunities.
Factry may share your personal data:
We can also share your personal data, based on our legitimate interest, to third party providers who help us in our employee journey. Examples include hosting our web servers, analysing data, and providing employee related service. These companies will have access to your personal data but only when strictly necessary to perform their functions and they may not use that data for any other purpose. Your personal data will not be sold or rented to third parties. We may disclose your personal data to enforce our policies, to comply with our legal obligations or in the interests of security, public interest or law enforcement in any country where we have entities or affiliates. For example, we may respond to a request by a law enforcement
We may transfer your personal data to third party providers who are located in third countries (outside the European Economic Area (EEA)), i.e. USA for CRM data. This data transfer outside the EEA is legitimate if the recipient of the data is located in a country which provides an adequate level of protection following a European Commission adequacy decision. Some of these countries may not have equivalent data protection legislation to protection the use of your personal data. In this case, we have assessed whether appropriate safeguards as within the EU are possible by, for example, executing standard contractual clauses. In particular cases, we will obtain your preliminary consent for transferring your personal data outside the EEA. Your personal data will be processed during the application and may be stored for 3 months afterwards. This allows us to contact you in the event that we might need an additional candidate, a replacement or have another opportunity that might suit your needs.
Whereas you have given your consent, your personal data will be saved for an additional period of maximum 3 years in our recruitment database for future opportunities.
In case of employment, the processing of your personal data will be necessary for additional purposes, which are managed by your employment contract and the additional documents (incl. privacy notices).
You are entitled to see the information held about you and to obtain a copy of the information we hold. If your personal data have been changed, you are entitled to ask us to rectify or complete or erase the outdated, incorrect or incomplete data we have about you. Furthermore you have the right to restriction of the processing of your data and to object to the processing of your personal data. We may require you to provide verification of your identity to ensure that you have a legitimate right to make the request and to verify that we provide the answer to the person that has the legitimate right to send us one of the abovementioned requests and to obtain the information. Please note that in certain circumstances we may withhold access to your information or that we may not grant your request where we have the right to do so under applicable data protection legislation. Factry is committed to trying to make sure that your information is secure.
